The charges of possession of weapons and cocaine charges against a pillar of the mafia in montreal are for the time being maintained, confirmed the Crown a few days after the accused was acquitted of gangsterism.
Leonardo Rizzuto, lawyer, son of the ex-godfather Vito Rizzuto, was back before the court this Friday, a few days after it was announced that the Québec superior Court.
Charged in a police operation antimafia, the 48-year old man was shot because police officers had unlawfully recorded without his knowledge in a law office. In a decision by a club, the court ruled that “State agents” had focused their investigation to the detriment of the professional secrecy binding upon the lawyers and their clients. The implementation of this means of investigation had been “misbehaving, or even negligent,” according to the judge Eric Downs.
Despite this victory, Leonardo Rizzuto is still accused of possession of cocaine and weapons (two semi-automatic pistols) that would have been found at his home during a search.
Given that this attachment stems from the raid antimafia, questions arise as to what will happen to these accusations. The prosecution did not wish to reveal his game, this Friday, when the case came back before the court.
“We requested a postponement, [the accusations] are maintained for the time being, the time to evaluate the impact of the judge’s decision Eric Downs,” said Crown prosecutor Matthew Ferguson.
The folder will come back before the court next month. By then, prosecutors will decide whether they are or not an appeal from a judgment ruling that the listening of which Rizzuto was the object was illegal.
