Tobacco and cannabis are banned in public places in Hampstead

    The town council of Hampstead adopted on Monday a law that prohibits smoking of tobacco or cannabis in any public place, either on the sidewalks, the streets or the parks in this small municipality well-to-do to the west of the island of Montreal.

    “Second-hand smoke is dangerous, particularly for elderly people who have lung disease and children, said the mayor of Hampstead, William Steinberg, by press release on Tuesday. This is the reason why we do not allow smoking in public to Hampstead.”

    “When marijuana becomes legal, smoking will also be banned in public places”, he added.

    A minimum fine of $ 100 is provided for a first offence, while it is at least $ 200 for a subsequent offence. The maximum amount may not exceed $ 600 for having smoked in a public place.

    The electronic cigarette, which is not considered as a tobacco product, is not covered by this regulation.

    The municipality claims to have the authority to be able to ban the use of tobacco and marijuana (once legal) under the municipal powers Act, which inter alia regulates its powers relating to the environment, nuisance, peace, order and the general well-being of its population.

    Hampstead has barely 7000 inhabitants and family income is among the highest in Montreal.
