At the end of a long legal battle, a judge city of Longueuil has decided thata owner of a pitbull aggressive could retrieve his dog, although it has been described as “dangerous”.
“The return of dogs to their owners, after the incident unfortunate and sometimes much more serious than what happened in the present case, is far from being rare,” says judge Pierre-Armand Tremblay in its recent judgment.
Cassy, a pitbull female who is now 10 years old, was seized in July 2016. The owner of the animal was then called the 911 because of his brother’s violent.
The police arrived promptly and came face to face with three pitbulls threatening.
“[The dogs] make them seriously fear for their safety,” notes the judge.
The situation with the brother was quickly resolved, but, as the dog Cassy had shown itself to be particularly aggressive, the agents, believing that it was “dangerous”, had seized.
“Lick the boots”
The Town wanted to euthanize Cassy, but Thérèse Duquette has fought hard against it. Cassy, it would have “saved the life” at a major depression in 2009, pleaded its owner. Its pitbull listen to “the finger and the eye,” she vowed.
A long court battle to recover the dog had followed.
Ms. Duquette, who was said to be ready to “lick the boots” of the prosecutor, did not skimp on the means to be successful, using the services of the famous lawyer Julius Grey and a veterinary expert in behavioral medicine.
This expert has called Cassy “moderate risk to public safety”.
Careless
The magistrate noted, however, that, even if Thérèse Duquette is willing to follow all the rules, this has not always been the case in the past.
He recalled that it was not licensed for his three dogs and that she had also “played the hiding place” by not declaring his dogs to the City of Longueuil.
It has, nevertheless, decided to make Cassy to its owner, especially as the latter has since moved into a residence without the immediate neighbours, in Saint-Calixte.
The judge also found that Ms. Duquette, although she had an “attitude reprehensible” in the past, had given sufficient guarantees to enable him to recover his dog.
However, Ms. Duquette, in spite of this favorable judgment, has still not recovered Cassy.
“The prosecutor does not want me to make it, it is the fury”, has told the Journal the woman who fears a call, with little means.
The City of Longueuil, on his side, has not yet decided whether it would appeal the decision.
