The president of the national consultative ethics committee (CCNE), the Pr Jean-François Delfraissy, had warned that the opinion on medical assistance to procreation (AMP) ” would not be unanimous “. After 4 years of reflection, the working group has recently made a decision in favour of the opening of the AMP for all women. An opinion eagerly awaited by the LGBT community. At the 40th gay pride March held on Saturday 24 June, the access to the AMP for lesbian couples was one of their main demands. It was also highly anticipated because the president and Emmanuel Macron said he was in favour of this evolution of the law during the campaign. As he had promised, he should follow the opinion of the CCNE.
But the extension of this right currently reserved for heterosexual couples infertile divides. According to a survey carried out by BVA for the Drees (1), 6 out of 10 French are in favour. The CCNE is also shared. If the majority of the 39 members voted in favour of an opening of the AMP to all the women, 11 were expressed for the maintenance of the status quo.
The arguments in favour of the opening
The great majority of the members of the CCNE have considered that there are 3 arguments justifying the opening of the AMP. “The technique is already authorized and does not pose the ethical problem, describes Frederic Worms, a professor of philosophy, contemporary French at the Ecole normale supérieure in Paris and one of the 3 rapporteurs of this opinion. In addition, the demand of women exists and we must take it into account “.
The committee considers, in fact, that between 2 000 and 3 000 French have crossed our borders to go to Belgium or Spain to get there. “To conceive a child in a context homoparental is a project thought long and hard, concerted, which made the pregnancy a scheduled event and desired “, they advanced.
“Finally, we have estimated that the relationship of the child to his origins and his parentage could be built even in those same-sex families or single-parent,” adds the philosopher, while stating that the CCNE recommends the implementation of studies on this subject.
