A doctor could be struck off permanently for failing to provide the medical records and the consultation of his patient Jonathan-Yan Perreault, nicknamed the ” king of the pharmacy “.
This is what has been called the syndic of the College of physicians before the disciplinary board on Friday for obstructing her work in the context of an investigation.
“Dr. Danielle Serra’s behavior is disturbing behavior for a large casual, irresponsible. This is not a disease, but of the negligence, even a kind of bad faith. […] It does not deserve to regain the profession, ” said Jacques Prévost, counsel for the trustee before the council, presided over by Lydia Milazzo.
The doctor is radiated on an interim basis since last march because she had failed to submit the documents of his patient despite requests from the trustee.
Dr. Serra is a family physician since 1975, and followed the patients in the Laurentians.
Medieval game
The impediment would be continued still, as Dr. Serra would have preferred to go to a medieval game in Shawinigan, rather than meeting at the beginning of the month.
“She knows that she is removed from the board, she has a sword of Damocles above the head, but she opts to go play in a game entertainment medieval. This is unacceptable. It is a lack of judgment and a lack of respect towards the public “, insisted Me Prevost.
An investigation was opened in connection with “allegations of irregularities” in the record of Jonathan-Yan Perreault.
Mr. Perreault has been deleted for more than 30 years last month. He was accused of the possession and the sale of expired drugs, claims the illegal to the Régie de l’assurance maladie du Québec (RAMQ), they have exercised their profession under the influence of psychotropic substances, among others.
Dr. Serra has pleaded guilty to the head of the offence of obstructing a little earlier this week. It would not have taken cognizance of the shipments of the trustee or of even those is hand-delivered by a bailiff.
Fear of the trustee
His lawyer, David Platt, explained that the doctor was “scared” of the trustee, and “froze” when she received communications from her. These fears were related to its past relations with the latter.
The requested documents needed from the doctor about his patient have finally been released following the cancellation of provisional.
To Me, Platts has indicated to the court that he would not seek to excuse his client because she had pleaded guilty. Rather, it has stipulated that the radiation that she is serving for six months was a sufficient deterrent, and that she had attended a course to improve.
He indicated that the impediment will last for not, since it was not available on the day of the meeting, in addition to adding that future communications between the trustee and Dr. Serra presented by his lawyers to avoid his fears prevent him from acting.
The doctor is referred to by two other heads of offence in another folder, which takes place at the same time as lucius, for failing to respond to an access request of a son in the medical file of his deceased father.
The council took the question under advisement and has 90 days to make its decision.
