Contract to Bombardier in Ontario: Metrolinx will not call

    TORONTO | The agency of transportation of ontario, Metrolinx will finally not appeal a judge’s decision forcing it to agree with the manufacturer Bombardier for a contract of 770 million $, which was signed in 2010.

    “We decided not to go forward with an appeal, has indicated to the QMI Agency in an email exchange with the spokesperson for Metrolinx’s Anne Marie Aikins. We focus instead our efforts on the dispute resolution process.”

    A judge of the Ontario superior Court of justice had ruled in April that Metrolinx could not cancel the agreement binding them to Bombardier and that the two parties had to find another solution to their dispute.

    The quebec company had filed an injunction in order to counter the efforts of Metrolinx to cancel its contract for the supply of 182 light rail.

    Bombardier has welcomed the decision of Metrolinx. “We will continue to work with them to find the best solution to ensure the success of the expansion of the Eglinton Crosstown for the benefit of travellers in Ontario,” said its spokesman Eric Prud’homme.

    In addition, Metrolinx has taken the decision to exclude Bombardier from the request for qualifications for an operator of its system at the end of the contract to Bombardier in 2023.

    “One of the main tasks of the new operator will be to identify ways to better manage our current operations and our service providers. A current director can’t make this work in an objective manner”, explained to the QMI Agency Ms. Aikins, noting that Bombardier could become a sub-contractor.

    The quebec-based company has expressed surprise at this decision. “This surprise is based on the excellent results achieved in the course of many years as a contractor for the operations and maintenance of the fleet and GO Transit, which is mostly comprised of cars and locomotives Bombardier”, said Éric Prud’homme.

    “Our balance sheet and operating and maintenance of these trains was no problem, he added. In the course of the last year, 99.5% of trains are maintained and operated by Bombardier Transportation arrived on time and, in 2017, despite the difficult winter, we are currently 99.7 % relating to our performance of trains arrived on time – a record.”

    While saying study the documents of the agency of transportation, Bombardier has guaranteed that it did not exclude any option in order to assert his rights.
