“All I had in the world, it was my brother. […] I had no reason to kill my brother “, dropped Robert Dubuc Friday before justice André Vincent of the superior Court.

The 64 year-old man wants out of jail until his trial for the murder not premeditated of his “little brother” Richard, 62 years old.

On October 5, last, the accused would have lost patience with the victim for some reason has not been specified Friday, at the palais de justice of Montreal.

    “An error “

“My brother is of dementia. It was going to hurt. I crash into a wall. I made a mistake, ” he reportedly told the dispatcher 911.

Robert Dubuc lived in Montreal-North with him for the past four years. “He was in his entire service,” he said, adding that Richard was suffering from dementia and schizophrenia, in particular.

The latter was unable to dress or wash alone. The man with the physical sickly was not able to cook and had problems with incontinence, which was a source of conflict between the two brothers.

According to the testimonies of neighbors related by the Crown, the quarrels were frequent.

On the evening of the death of Richard Dubuc, neighbors would have heard him beg his brother to stop hitting him. When paramedics arrived, the victim was unconscious in his bed. Richard Dubuc died in the night.

    Alcohol

“I took it by the face and I crashed into the wall. I’ve lost patience, ” would have said Robert Dubuc, to the police. The accused smelled strongly of alcohol.

Friday, the sexagenarian has explained to the court that his brother’s condition had degraded after a change of medication in the months preceding the drama.

“This is where I lost it. Maybe I’ve taken a glass too much to compensate, but I’ve never done anything intentional, ” he argued.

The Crown opposes the release of Robert Dubuc because of the seriousness of the action alleged. “It hit [his brother] until he has a traumatic brain injury. It was a vulnerable person, under its full responsibility, ” argued Me Jasmine Guillaume.

The defence is of the opinion that the facts are similar to a manslaughter.

“I think that a well-informed public […] would be the case pathetic and would not be offended by a handing-over in freedom,” said Louis Miville Deschênes.

The judge Vincent will decide Monday.
