Unreasonable delay
Since then, the folder dragged before the courts, complain to Ms. Wolfe and Mr. Lemay-Thivierge, since separated. The building now belongs to Mariloup Wolfe, who says in a court document to have ” personally had no involvement in the demolition of the building “.
The two artists have relied on the unreasonable delay to cancel the procedures.
“The time which will have elapsed at the trial, since the facts will affect necessarily their right to a full and complete defence,” wrote the lawyer of the ex-couple, back in October, trying to avoid its customers a trial and dismiss the ticket.
Because the more time passes, the more the memory of their witnesses is likely to be affected, called it.
“[The defense] must demonstrate that the building in question has not been demolished more than 50 %, and this, while the building has, since the events, was completely rebuilt “, one can read in the folder.
The judge of the municipal court Lison Asseraf, however, has rejected this request last Friday.
Unless Ms. Wolfe and Mr. Lemay-Thivierge pay their ticket of $ 50,000, the trial should be held at the end of march.
Mariloup Wolfe has kindly declined the offer of interview to the Journal.
Guillaume Lemay-Thivierge has not wanted to comment on the case.
