One of three men accused of the gang-rape of a minor girl at a rave in Victoriaville has failed in his attempt to be released during the appeal proceedings of his sentence of five years.
On appeal of his sentence for sexual assault with injury to a young girl of 15 years, deeming the penalty ” cruel and unusual “, the lawyers of Dominic Vézina have called for the release of the accused during the proceedings. The accused argues that ” the exposed mechanical and repetitive, the judge (during instructions to the jury) is unnecessarily complex and unfair.”
In his decision, judge Dominique Bélanger is, however, undermined the main argument of the appellant. “The only way relating to this conviction is the one connected to the exposed mechanical and repetitive, the middle of which the plausibility-in-law seems to me rather weak,” he wrote in the judgment.
The court added that the dropped items in the query to obtain the release of Dominic Vézina during the appeal of his sentence of five years “does not support the assertion” in question.
It concludes that a well-informed person would misunderstand that Vézina be released ” so that the way to call it ahead […] is low “. For this reason, the release of Dominic Vézina has been rejected.
Remember that a man of 23 years old is the only one to have increased its appeal. Jean-Christophe Martin has accepted his sentence of five years “as a man” in the opinion of the judge, while Pierre-François Blondeau, aka Midaz, received a sentence of 30 months.
