The criminal Gérald Patoine, convicted of second degree murder in 2007, is too dangerous to be released even in the terminal phase of an incurable disease.
Patoine, aged 44, is currently serving a life sentence for a double murder on November 23, 2004 Chicoutimi.
The latter pleaded guilty in march 2007 to charges reduced, but without the possibility of parole before 20 years. Because of her state of health, his entourage has relied on exceptional circumstances before the parole Board of Canada (PBC), but the authorities have denied his request. He would have been able to get out of the penitentiary waiting for a place in palliative care.
High risk
“The Commission takes into consideration your past criminal where there are very serious crimes, such as murder, manslaughter, and sexual assault that have left some serious damages to your victims,” one can read in the decision.
The commissioners conclude that the risk of recurrence is still high and that only a reduction of its mobility reduces this risk.
“The Commission takes into consideration that you will be released in a public place, without constant supervision and with a vulnerable population, who does not know your history,” adds the PBC, which considers the risk unacceptable to the company.
Gerald Patoine will be eligible for parole in December 2024.
Dangerous prisoner
Since his incarceration, he has ” conducted disruptive “, extended stays in institutions, in maximum security and segregation placements. He did not follow-up program in respect of his sex offending. Reintegration potential is low, according to the PBC.
Gerald Patoine himself had warned the police of the death of Daniel Lemieux, one of the two victims.
The victim’s body was pierced by 53 strokes of the knife.
Shortly after, the police discovered also the corpse of the ex-spouse of Lemieux, Karine Gaudreault, in another residence of Chicoutimi.
The man was killed with a knife and the woman by strangulation.
