The two men who had robbed a salon of erotic massage after being paid a good time with female employees have been betrayed by a condom soiled left before their flight.
“The evidence reveals a key element for the accused : her DNA is […] in the condom thrown into the trash “, said the judge Linda Despots Friday, before declaring guilty Tai Guo and Zhen Wang of robbery and forcible confinement.
The two men of 42 and 35 years old have committed their theft in November 2010. On this day, they were presented in a salon of erotic massage located on Decarie boulevard, in Montreal.
Once inside, Wang preferred to discuss everything and nothing with the owner, while his sidekick was directed into a room with a masseuse, to have a sexual relationship protected. The whole thing lasts about an hour.
“When she has finished, she puts the condom soiled and its envelope in a paper handkerchief […] and throw it all in the trash “, explains the judge.
But rather than pay, and from, the two men robbed the massage parlor armed with a gun and a knife retractable. The four women were tied up and one of them was hit twice by Wang.
Denial
“They leave after you have stolen a bit of money and personal property belonging to the four women,” explained the magistrate.
When the police arrived on the scene, the women were able to give a description of the two suspects. But the condom soiled thrown in the trash has given additional ammunition to the investigators to allow incriminate the duo.
At trial, the defendants had vigorously denied being the perpetrators of the robbery, even if the victims were recognized in a parade photo submitted by the police.
Because the testimony relating to the identification of a suspect are fragile, recalled the judge. Also, during the testimony of one of the victims, the Crown had asked him to look in the room to see if she could see the suspects. However, there were only two Asians in the room, or the two accused.
“This situation illustrates beautifully the fragility of an identification in the court room,” said the magistrate.
DNA
The DNA of Guo in the condom has thus dispelled any doubt on the guilt of the accused, who may now be a minimum of three years of penitentiary.
Arguments on sentencing will be held in November, at the palais de justice of Montreal.
By then, Wang will remain on bail.
Guo, for his part, is already detained. He awaits his sentence in another case, two violent invasions in homes inhabited by elderly people.
